The following instructions are NOT related to the CM/ECF system of electronic filing. The requirement to hyperlink your case law is a new requirement implemented by all judges of the U.S. Bankruptcy Court of the Eastern District of Kentucky. Although the requirement is independent of electronic filing, the ability to hyperlink in the manner that the judges require does involve some computer expertise. Therefore, instructions for this procedure are being set out below. |

PURPOSE: |
|
The purpose of linking case law to its citation within ONE pleading is to create portability. This allows the judge full access to this information, when needed, via laptop computer even if no internet access is available. |
|

|
|
COLLECTING THE CASE LAW ON WESTLAW |
|
|
|
|
|
STEP 1 |
|
Log in to Westlaw via the Internet at www.westlaw.com. |
|
|
|
|
|
STEP 2 |
|
Enter your Westlaw password and “Client” name. |
|
|
|
|
|
STEP 3 |
|
Do any necessary research to find the case law or, if you already know the citations, type the citation into the “Find this document by citation:” field as shown below.

|

|
Click the |

Once the case is displayed, click on the

The “Current Destination:” will default as shown below.

Repeat the above steps for each case that is cited in your pleading. |

Navigate (if necessary) to the following drop down menu.

Navigate to the folder into which you wish to save the cases and name the file. Make sure that the extension is correct. It should be .doc for Word documents or .wpd for WordPerfect documents. Click the |

Open the memorandum or other document you intend to file with the court, and copy or attach the downloaded cases onto the end of that document. |

|
STEP 3 |
|
Resave the document. |
|
|
|
|
|
STEP 4 |
|
Then go to each case that is attached and create a Bookmark for that case. See instructions below. Follow the procedure below for all cases that were copied into document. |

|
Finally, create a hyperlink to each bookmark. See instructions below. |

STEP 1 |

Go to the text in the copied case law and highlight a main word or two (either from the case title or regarding the point of law to which the pleading is referring).

Click the bookmark
Or, you can click on “Tools” and “Bookmark”.

This dialog box will then appear.
Click the “Create” |

The following dialog box will then display with the highlighted text inserted as the proposed bookmark name.

Type in a short name for the bookmark. (NO SPACES BETWEEN WORDS)

QUESTION: |
|
I need to attach exhibits to judge’s copies, how do you want to see them? |
|
|
|
|
|
|
ANSWER: |
|
You may transmit exhibits in pdf format as separate documents since you cannot link to scanned docs. But, you will need to make reference to these documents within your brief, etc. as to their location by using the hyperlink feature. |

|
|
QUESTION: |
|
May we have additional time to prepare the judge’s copy since it takes some extra preparation? |
|
|
|
|
|
|
ANSWER: |
|
It is not necessary to transmit the judge’s copy at the same time as filing in order to give you some time to prepare appropriately. EXCEPTION: If time is of the essence, i.e. a hearing is scheduled very shortly, we would need the judge’s copy accordingly. |

QUESTION: |
|
Why can’t I use the Westlaw or Lexis automatic hyper-linking function? |
|
|
|
|
|
|
ANSWER: |
|
There are a couple of reasons. First, and foremost, is that using those features destroys the portability of this information. The judge uses his laptop frequently in different locations, some of which do not have internet access. He needs this information in a user-friendly format. |

Will these instructions be accessible on the court site? |
|

ANSWER: |
|

YOU WILL NEED THE HYPERLINK TOOLBAR, and BOOKMARK BUTTON
Westlaw via Internet, Downloading multiple jobs to attach to Briefs, other documents:
Enter Password
Find: Enter cite, will load case
PRINT ALL OPTIONS drop down box, choose Current Document
Destination Screen: Drop down box, choose "Save on Westlaw", OK
Repeat above for each case needed
When search complete:
Go to right side drop-down menu, choose "Offline Print Directory", click Properties, will see File Format Screen, click drop down box and choose WP or Word, Check the box at bottom to automatically save as default setting. The next time you enter the "Offline Print Directory", your selection will automatically default to "Download via WP or Word".
Will see List of Cases Gathered, check ones to download, NEXT
Destination Screen: Drop down box, choose "Download via WP or Word", OK
RIGHT click Download Button, Save Target As
Save As Screen will appear, place download where you want it. (You can change the name of the job, but leave the correct extension, i.e. "Doc" for Word or "wpd" for WP, SAVE.)
Sign Off Westlaw, File, Close
