New
Standing Order effective December 1, 2008, repealing Standing Order of
October 17, 2005 (adopting Interim Bankruptcy Rules) and retaining Interim
Bankruptcy Rule 5012. Also New
Standing Order effective December 19, 2008 adopting Interim
Rule 1007-I, as a local rule.
Amendments to the Federal Rules of Bankruptcy Procedure took effect on December 1,
2008. The
amendments and new rules implement substantive and procedural changes to the
Bankruptcy Code made by the Bankruptcy Abuse Prevention and Consumer Protection
Act of 2005. They will also supersede interim Bankruptcy Rules adopted generally
by the bankruptcy courts in October 2005 when most provisions of the Act took
effect. Because the new rules will supersede the interim rules on December 1,
2008, bankruptcy courts have been advised to repeal their interim
rules when the new rules take effect on December 1, 2008. The amendments and new

Standing Order effective
March 7, 2008 governing Objections
to Confirmation
Beginning
Monday, March 10, 2008, our Court implemented the Reduced Paper Module (RPM)
within CM/ECF. This feature eliminates mailing of paper
notices through the Bankruptcy Noticing Center (BNC) to registered CM/ECF e-mail
recipients. This removes the need for registered users to sort through
duplicate paper and electronic notices. Under RPM, debtors, creditors, and other
parties not registered as CM/ECF users continue to receive paper notices through
the BNC. Since e-mail will be the only method of
service to registered users, it is extremely important that all registered users
update their e-mail address immediately in the event of a change. It is up to the attorney to ensure that they receive e-mail notices
in a timely manner. An attorney can run the “Activity in My Cases” Report to
verify what e-mails they should have received. The Clerk’s office cannot
re-send any lost e-mails. However, the Clerk’s office will make every effort
to ensure that e-mail delivery failures due to isolated circumstances beyond the
recipient’s control are delivered when the problem is identified.
New Privacy Rules
December 1, 2007:
On December 1 amendments to the Federal Rules of Bankruptcy Procedure implementing the E-Government Act of 2002 become effective.The amendments require that personal identification information be redacted from documents filed with the court — individuals' SSN and taxpayer ID numbers, names of minor children, financial account numbers, dates of birth, and, in criminal cases, home addresses.

Tuesday
LEXINGTON / FRANKFORT: First Thursday after
the 3rd Tuesday.
No other divisions are affected, and hearing times remain the same.
As of 2007, all
Frankfort motion day hearings are heard at Lexington (2nd floor courtroom)
beginning at 10:00 a.m. See Standing Order effective June 1.
